We are experienced transactional lawyers, including experience of sales and purchases with a multi-jurisdictional element. We regularly advise at board room level on corporate governance and director duties in the private and public sector, with particular experience of the issues that directors face in the ‘twightlight’ period.
When acting for insolvency practitioners we appreciate and understand their regulatory and statutory duties which assists us in driving legal processes to meet their needs. This is further aided by the fact that the head of our Business Support and Insolvency Team, Paul Caldicott, is a qualified Insolvency Practitioner and representative on the Joint Insolvency Committee.
We are experienced in all forms of antecedent recovery, search and seizure powers and work hard to negotiate, mediate or litigate claims to a successful conclusion.
We are regularly asked by banks and other lenders to advise upon the recovery options available to them. We routinely provide security and title reviews, sometimes to very tight deadlines and we will work to a fixed fee or on a contingency basis. We have experience of drafting bespoke letters of demand, advising on possible appointment challenges, contrasting receivership with administration, and informal restructuring solutions, including a debt for equity swap and freehold participation agreements.
Our bankruptcy practice includes council tax recovery work for English and Welsh local authorities. We operate a fully-funded bankruptcy petition service and will attend on-site to work with your recovery staff to maximise collection revenues.
