It is important to ensure that any plans are achievable intra vires. Our lawyers are able to provide specialist advice on constitutional issues, including governance and probity, to help with the audit of policies and to ensure overall compliance with relevant legislation. 

There is an increasing volume of new legislation, regulations and guidelines which includes, The Human Rights Act, the Data Protection and  Freedom of Information Acts, the Disability Discrimination Act, Special Educational Needs and Disability Act and the Licensing Act 2003.  In addition, there is the recent Higher Education Act. 

We have many years experience in advising education and other public bodies in connection with the particular idiosyncrasies of their constitutions whether founded by statute or Royal Charter.  We have advised on drafting interpretation of statutes, ordinance and regulations. Whilst the constitutional basis for further education colleges is less cumbersome our experience of grappling with issues of interpretation and governance in the higher education sector give us a clear insight into the principles which apply.
