dispute management

Although our solicitors are skilled in dealing with all aspects of court proceedings (ranging from urgent injunctions in fraud or intellectual property matters to appeals to the Court of Appeal or House of Lords to enforcement, including insolvency matters) we are strongly committed to using alternative dispute resolution (ADR) for all cases where it is suitable. (ADR encompasses a wide variety of non-court-based processes for resolving disputes through agreement, without a judge or arbitrator. The commonest form of ADR is mediation, though our lawyers are also experienced in resolving disputes through neutral evaluation, expert determination and adjudication.) ADR works if you know how – but it is a trap for the unprepared. Our lawyers regularly take a wide variety of complex cases to successful conclusions through mediation and other forms of ADR, representing our clients tenaciously through tough negotiations and achieving outcomes that are cheaper, quicker and more focussed on business needs than court proceedings can deliver.

We firmly believe in prevention rather than cure, and frequently advise clients on dispute avoidance and best practice as well as providing ‘behind the scenes’ advice on how to resolve disputes informally in the early stages wherever possible. However, when a dispute cannot be avoided we have the skills and experience to help you achieve the right solution. Most importantly, we have a great team of people you will enjoy working with.
