Website Compliance

The Companies Act 2006 introduced changes to information requirements on corporate websites which came into effect on 1 January 2007.

From 1 January 2007, corporate websites must include the following information:

  • the company name, and any trading name where this is different;
  • the company’s registration, registration number and registered office;
  • an email address to contact the company;
  • details of membership of any trade or professional association;
  • VAT number (where applicable)
  • where the business is being wound-up, a statement to that effect

The information does not need to be provided on each page of the website, and for most businesses the about us section, or terms and conditions will be the most appropriate place. This information should also appear on any online order form.

Although many websites will satisfy most of the new information requirements, changes will also need to be made to corporate email – which must also include the first three items above. Going forward email will be treated in the same way as corporate letter-head under existing Company legislation.

Failure to comply with the new information requirements constitutes an offence for which the company and/or any responsible officer could be liable to a fine.

Tangled Up in Web Compliance?

With increasing regulation and new online information and services, it can be difficult to maintain a compliant website.  Out of date terms and conditions; poor IP protection or non-compliant data protection practices can expose a business to liability, and reduce brand value.

Morgan Cole can help you to minimise legal and commercial risks associated with maintaining an online presence, and ensure that visitors to your website enjoy a positive experience, by assessing and identifying the risks and helping you to priorities changes with minimal disruption to your business.
